Answer:

Who is Entitled to the FMLA? The Family and Medical Leave Act, or the FMLA, and its counterpart in California, the California Family Rights Act, the CFRA, provide protection when employees need leave from work. To get this leave under the FMLA, the business must have at least 50 or more employees in a 75-mile radius. The employee must have worked at least one year for their employer, and during that year must have worked at least 1,250 hours. It’s similar under the CFRA, but in 2021 that’s changing to 5 or more employees. If there are other circumstances that go along with it, then it oftentimes involves a very fact-sensitive analysis to determine how many hours the employee is entitled to or how many hours they have left, if they’ve used some time.
