In the state of California, it’s illegal to harass an employee based on their sex or any protected characteristic. To prove this, the conduct has to be severe or pervasive, and this is a very fact-sensitive element to prove. Some courts say to be severe, it takes one comment or action, and some courts say it takes more than one comment or action.
