Racial Discrimination

A few years ago, we represented a Hispanic employee who was not promoted. What had happened was there was a promotion position available for a supervisory role at his office. That employee had been in an acting position in that supervisory role for over a year and a half. For a year and a half, he was doing the job that he was now applying for. He scored higher in the interview process, he had great evaluations, yet he wasn’t selected for that position. The person that was selected was much less qualified. They had less experience on the job, and they had never worked in an acting position in that supervisory role.

After we got the case and did some discovery, we found out that the supervisor had been making derogatory comments about Hispanics at work. This has been going on for a long time. In the state of California, it is illegal to discriminate against an employee based on their race or color.
