Looking For Employment During a Pending Wrongful Termination Case

Last year, we were representing a client who worked for a government agency in Los Angeles County, and the client was wrongfully terminated. The question came up of whether or not they should be looking for another job. Generally speaking, as long as you’re healthy and able to do so, there’s an expectation by the courts that the employee will seek comparable work, and they should make a reasonable effort to find comparable work, comparable to the job that they previously had. There are times where an employee is unable to find comparable work, but has made a reasonable effort, and had to settle for a job that paid less. That’s acceptable as well.

Generally speaking, as long as you’re healthy and you’re able to do so, you should try and find comparable work. We’ll find that most people want to work and go out and find another job.
