How long do I have to file a whistleblower claim in California?Answer:
We recently received a call from a potential client who worked in Los Angeles County, and that client told me that he was retaliated against in the workplace for reporting something that he believed was unlawful. For years, he tried to ignore the retaliation and just let it go by. The question that came up was how long he had to file a claim. This varies with the different types of employers. Some employers or government agencies involve some administrative matters that have to be handled before you can file a lawsuit. You have to file a government claim, in some cases, within six months of something happening, if it’s against a government employee. Generally speaking, if it’s not against a government employee, you have anywhere from one year to three years to file your claim, depending under what whistleblower statute you’re going to sue under.
