Can I file an employment law claim in Orange County if I quit my job?Answer:
Last year, we were representing a client who used to work in Los Angeles County, and she had quit her job. She quit her job because of the harassment that was going on, and it got so severe that her working conditions became intolerable. Under the law, this is called constructive termination. You can still sue your employer under certain circumstances, even if you are the one that actually quit your job.
There are certain factors that are required to be met, and some of those are that the employer has made your working conditions so intolerable that you had to quit. This means, essentially, what the employer is doing is treating you so badly that they don’t want to say that you’re fired, but they’re going to make your working conditions so intolerable that you have no reasonable choice but to say, “I quit.” That is a claim that you can sue for in court in California.
